Notice of claim

A contractual notice that a party intends to claim more time or money, which many contracts require within a fixed period.

Under FIDIC’s 2017 contracts (Sub-Clause 20.2.1), a claim must be notified within 28 days of becoming aware of the event, or the other party can be discharged from liability. Under NEC4, a compensation event not notified within eight weeks may not change the prices or dates.

The clock usually starts when the team becomes aware, not when the commercial team hears about it.

Where it goes wrong

Delay events are discussed in site chats the commercial team never reads, and the notice period runs out before anyone drafts the notice.

What Spurby does

Spots events that can trigger a notice, records when the team knew, and counts down the contract’s period.
